Three reasons I recommend all my clients get a cohabitation agreement / prenup:
🤝 Provides financial security: A prenuptial agreement can provide both parties with financial stability and peace of mind. It sets out how assets would be shared in the event of a separation, which can help reduce worry and ambiguity about the future.
🤝 Protects future income: If one or both parties anticipate receiving a substantial inheritance (and want to ensure co-mingling doesn’t make that inheritance shareable), an increase in net worth, or want to provide clarity that business endeavours are a separate asset etc, a cohabitation/ prenuptial agreement can help preserve these assets in the case of a separation. This is especially crucial for those who have developed their own enterprises or have substantial assets prior to the marriage. The agreement can also contemplate whether debts accrued during the relationship will be shareable.
🤝Encourages open and honest conversation: Creating a prenup demands an open and honest dialogue about finances and relationship expectations. This technique has the potential to strengthen the connection and prevent future disputes. By having these discussions early on, both partners can enter the cohabitation/ marriage knowing the other’s financial goals and expectations.

One thing that a lot of people may not know about getting a divorce in Manitoba is that there is a mandatory one-year waiting period before a divorce can be granted.
