The legal process does not need to increase conflict and disagreement between spouses. The professionals involved in the collaborative method are committed to helping spouses communicate effectively, respectfully and fairly to resolve their family law matter and to set them up to communicate in this way in the future - as co-parenting and communicating with your spouse doesn’t end when the relationship ends.
The professionals in the collaborative method (lawyers, communication/parenting coaches, and if needed a financial professional and/or child specialist) are there to focus on the client’s goals and are committed to the positive reorganization of your family. The lawyers will provide recommendations for other professionals. The goal is to reach mutually beneficial solutions that places the children’s best interests at the fore front. The Collaborative method is equally beneficial for spouses who do not have children.
All conversations and exchange of documents in the collaborative process are private and confidential.
The collaborative method allows spouses to keep control of the process and the outcome of their separation. Each spouse will have their concerns addressed in a respectful and meaningful way. The decisions made will be yours - not that of a Judge.
The collaborative process is often a much quicker and more cost effective method to resolve family law issues than the alternative of proceeding to court.

Collaborative family law
A method that allows spouses to keep control of the process to resolve the issues of their separation without engaging in the adversarial Court process. The end of the process results in a Separation Agreement.
SEPARATION AGREEMENT
An Agreement reached between two separated parties that contains agreements with respect to custody, child support, spousal support, property division, pensions and child relevant provisions (such as travel, holiday time etc). Kimberly Soul can provide the drafting of a Separation Agreement and provide independent legal advice with respect to terms of a Separation Agreement reached between spouses whether they have reached resolution through the Collaborative process or otherwise.
COHABITATION AGREEMENT
An Agreement reached between two parties considering cohabitation, or already doing so, that allows them to agree now what would happen with their assets, debts and support should they one day separate.
OBTAINING AN UNCONTESTED DIVORCE
The process of obtaining a divorce in Manitoba requires a Petition for Divorce to be filed and served along with corresponding documents. Once a Divorce Judgement is pronounced the divorce will become final after 31 days at which time a Divorce Certificate can be ordered from the Court to complete the divorce process.
FAMILY Mediation
A process whereby a neutral third party assists parents and/or separating spouses find mutually agreeable solutions to the problems surrounding separation and facilitate a mutually agreeable co-parenting plan. Kimberly Soul has a Certificate in Family Mediation Training. The parties are in control of the process. The mediator does not make decisions but rather facilitates communication to assist the spouses with reaching a consensus. The agreed upon terms can be formalized in a Separation Agreement. Each party would require Independent Legal Advice on the terms reached.
pre or post nuptial agreement
An Agreement reached between two parties contemplating marriage, or after marriage, who wish to determine now what would happen with their assets, debts and support should they one day separate.
Consent cOURT ORDERs
An Order whereby the terms are agreed to between spouses. Kimberly Soul can assist with the drafting, independent legal advice and obtaining a Court Order which contains the terms of a Separation Agreement (whether reached through the Collaborative process or otherwise) or terms consented to between spouses.
